WARRANTY – DENTAL PRODUCTS OF OTHER DENTAL IMPLANT MANUFACTURERS

The dental products are designed to also be used in conjunction with dental implant components from other dental implant manufacturers.

Where a dental product is used as mentioned above, Race Dental will, in respect of the relevant dental implant component provided by that other dental implant manufacturer, either provide a free replacement component or pay the then current catalogue price charged by the other dental implant manufacturer for obtaining a replacement component (as selected by Race Dental) where the following conditions are met:

(a)  the dental implant component provided by the other dental implant manufacturer is defective and that defect is attributable to the other dental implant manufacturer;

(b)  the dental product provided by Race Dental was properly used in conjunction with the dental implant component of the other dental implant manufacturer;

(c)   the dental product provided by Race Dental was appropriate for use with the particular patient given their circumstances;

(d)  a written claim on Race Dental to provide such replacement or the cost of obtaining such replacement is made which attaches to it a copy of the relevant invoice from the other dental implant manufacturer in respect of the defective dental implant component with lot number and product code of the implant to be supplied – in addition to the below point, this claim must be received by Race Dental within 30 days after the claimant became aware of the defect or should have reasonably become aware of the defect;

(e)  at the time of receipt by Race Dental of the said written claim, such defective dental implant component was within the warranty period offered by the other dental implant manufacturer in respect of that component;

(f)   a written claim in respect of the defective dental implant component has been made under the warranty given by the other dental implant manufacturer but it has been rejected solely on the grounds that it is void because the relevant component was used in conjunction with a dental product of Race Dental;

(g)  the other dental implant manufacturer has refused to remedy the defective dental implant component they provided;

(h)  all relevant dental components including the defective component, implant and associated restorative crown are returned to Race Dental offices for assessment; and

(i)   if the claimant relies on this warranty, then this is the claimant’s sole remedy.

This warranty is not transferable.

LIMITATION OF LIABILITY

Subject to the terms of the warranty referred to above, to the fullest extent permitted by law:

(a) Race Dental are not liable for any losses or damages (whether direct or indirect), including personal injury, consequential, economic, special, incidental or other indirect loss or loss of profits arising out of the provision, performance, non-performance, defective performance, installation, arising in contract, negligence or howsoever arising, or use of any products supplied by Race Dental irrespective of whether or not Race Dental was made aware of the possibility of such loss;

(b) all warranties, terms, conditions, liabilities and obligations in relation to any products supplied by Race Dental including those implied by use, trade, custom or otherwise other than those specified in this warranty are hereby excluded;

(c) subject to (and without derogating from) the foregoing, Race Dental total liability for any cause of action whatsoever (including negligence) is limited at Race Dental option to:

(i) in the case of ‘goods’, to replacing or resupplying the goods or paying for the cost of replacing or resupplying the goods; and

(ii) in the case of ‘services’, to supplying the services again.

RECOMMENDATION

It is strongly recommended by Race Dental that the user of any products supplied by Race Dental studies the latest developments of Dental Implant Systems and their applications regularly.
